ScanPlus is a business management SaaS platform that provides digital tools for restaurants and membership-based businesses. Services may include: QR menu experiences, order management, business dashboards, membership management, subscription plan management, QR membership/status lookup, analytics, payment tracking, receipt communication, public business pages, and support services. By using ScanPlus, users agree to these terms.
2. Definitions
- Platform: ScanPlus website, dashboard, APIs, public pages, and services
- User: Registered account owner
- Business: A business entity managed through ScanPlus
- Member: End user/member/customer managed by a business
- Subscription Plan: A paid or trial plan granting access to platform features
- Public QR Page: A publicly accessible page generated by ScanPlus for business interactions
- Content: Business-uploaded data, menus, members, branding, etc.
3. Eligibility
Users must be legally capable of entering agreements. Businesses are responsible for lawful use. Users must provide accurate information.
4. Account Registration
Users may need to: register an account, verify email, provide business information, and select business category. Users are responsible for: account credentials, account security, and activity under account. ScanPlus may suspend suspicious accounts.
5. Business Category Usage
ScanPlus supports category-specific workflows.
Restaurant businesses: QR menus, orders, table management, offers, taxes, analytics
Membership businesses: member management, memberships, subscription lifecycle, payments, receipts, QR status lookup, analytics
Feature access depends on subscription plan and category.
6. Subscription Plans & Billing
Access may be subscription-based. Include: free trial, paid plans, plan upgrades, plan downgrades, plan expiration, and feature restrictions.
Subscription features depend on: business category, country pricing, and active plan. Only active subscriptions provide paid feature access. If subscription expires: certain features/public pages may be restricted.
7. Payments
If payment functionality is enabled: users may pay through supported providers (e.g., Razorpay, Stripe, or equivalent providers). ScanPlus may record transaction metadata. Third-party processors handle sensitive payment processing. If manual admin plan assignment exists: mention billing adjustments may be handled administratively.
8. User Responsibilities
Users/businesses are responsible for:
- maintaining accurate business data
- lawful business operations
- lawful communication with customers/members
- lawful handling of personal data
- compliance with tax/payment obligations
- proper use of QR/public pages
- not misusing the platform
9. Member / Customer Data Responsibility
Businesses control the member/customer data they enter. Businesses are responsible for obtaining lawful permissions for: member/customer emails, phone numbers, membership records, and communications. Especially mention: education/coaching businesses remain responsible for student/member compliance obligations.
10. Public QR Experiences
ScanPlus may provide public business pages such as: restaurant QR menu pages, membership status lookup pages. These pages may be publicly accessible without login.
Businesses are responsible for: enabling/disabling usage where applicable, ensuring appropriate data use, and lawful operation. ScanPlus may restrict access if subscription becomes inactive.
11. Email Communications
ScanPlus may send: email verification, password reset, account notices, subscription notices, billing notices, membership receipts, support communications, and service alerts. Emails may be sent using ScanPlus infrastructure. Businesses are responsible for lawful customer/member communication where applicable.
12. Acceptable Use
Users must not:
- misuse the platform
- attempt unauthorized access
- disrupt services
- abuse APIs
- scrape protected data
- perform fraudulent activity
- impersonate others
- upload unlawful content
- violate privacy laws
- abuse public lookup functionality
Mention rate limiting and anti-abuse protections.
13. Data Accuracy
ScanPlus is not responsible for incorrect business-entered data. Examples: wrong menu pricing, wrong member data, wrong membership status, incorrect contact details, outdated business information. Businesses are responsible for accuracy.
14. Platform Availability
Platform availability is provided on a commercially reasonable basis. Temporary downtime may occur due to: maintenance, hosting issues, third-party outages, upgrades, security incidents. No guarantee of uninterrupted availability.
15. Intellectual Property
ScanPlus owns: platform software, branding, UI, code, systems, designs, and documentation. Businesses retain ownership of their own uploaded business content. No unauthorized copying/reuse.
16. Third-Party Services
Mention possible third-party dependencies: hosting, payment gateways, email providers, analytics providers, infrastructure providers. Their own terms may apply.
17. Limitation of Liability
To the maximum extent permitted by law, ScanPlus shall not be liable for indirect losses, business interruption, lost revenue, incorrect business-entered data, payment processor failures, email delivery failures, public internet issues, or misuse by business users. Keep commercially standard wording.
18. Termination / Suspension
ScanPlus may suspend or terminate access for: violation of terms, abuse, fraud, unpaid subscription, security risk, unlawful use. Businesses may stop using platform at any time subject to subscription terms.
19. Refunds
Align with actual refund policy. Reference: Refund/Cancellation policy page if applicable. Avoid contradictory wording.
20. Privacy
Reference Privacy Policy page. Clarify privacy practices are governed separately.
21. Changes to Terms
Terms may be updated periodically. Continued use indicates acceptance. Update "last updated" date accordingly.
22. Governing Law
Add jurisdiction aligned with actual business registration. Example: India jurisdiction (if applicable). Do not invent jurisdiction if not configured.
